Personal Injury Case Settles For $187,500.00

Automobile accidents happen. Often an automobile accident can be prevented; however, if you are involved in an automobile accident, the only real way to protect yourself is to make sure you are wearing your seatbelt and have adequate insurance to protect yourself and your family. Here, is an example of one of our clients who did nothing wrong and found herself facing difficult decisions after an accident. Obviously, we changed Ms. Smith's name.

On June 17, 2009, "Sandy Smith", was rear ended on Metro Parkway in Fort Myers, Florida when a driver of a landscaping truck bent down in his vehicle to pick up a clipboard. Mrs. Smith was 42 years old, a nurse, a wife and a mother to her disabled daughter who she had to lift in and out of a wheelchair every day.

Following the accident, Mrs. Smith presented to Lee Memorial Hospital with severe neck pain. An MRI performed in June 2009 revealed a ruptured disk in her neck. Not wanting to rush into surgery due to caring for her small disabled child and trying to earn a living, Mrs. Smith decided to try conservative medical care to alleviate the daily pain. However, after 13 long months of unsuccessful chiropractic care, physical therapy, and needle injections, Mrs. Smith underwent surgery in July 2010. Her neurosurgeon performed an anterior cervical discectomy and fusion with anterior plate fixation.

Mrs. Smith asked the Dellutri Law Group to assist her in an action against the Landscaping Company and the driver for their failure to excercise proper care and attention to their responsibilities on the road. Mrs. Amanda Downing, a Partner at The Dellutri Law Group provided the Defendant's insurance company with the neccesary information to understand the pain and suffering endured by Mrs. Smith for the 13 months prior to the surgery and then the recovery period thereafter. Mrs. Downing was able to explain the nature of caring for a disabled child so that the insurance company could appreciate what the accident took away from Mrs. Smith and her daughter and husband.

The parties eventually reached a settlement in the amount of $187,500. The good news...........Mrs. Smith is back to work and is now enjoying and caring for her family. The settlement will go a long way toward putting these wonderful people back on the road to recovery.
